What to Expect at Your 341 Meeting in Orlando

Once you’ve filed Chapter 7 bankruptcy in the Orlando Division of the U.S. Bankruptcy Court for the Middle District of Florida (which covers Brevard, Lake, Orange, Osceola, Seminole and Volusia Counties) your next important step is attending the Section 341 Meeting of Creditors. Most people feel nervous when they hear the term “meeting of creditors,” but the 341 meeting is usually quick, simple, and nothing to fear.
This guide explains what happens, what to bring, and how to feel prepared.

What Is the 341 Meeting?
The 341 Meeting is a mandatory interview conducted by your bankruptcy trustee. You will be placed under oath to answer various questions about your financial condition and the circumstances leading to your Chapter 7 filing. The meeting:
Confirms your identity
Ensures your bankruptcy paperwork is accurate
Gives creditors a chance (rarely used) to ask basic questions
It is not a courtroom hearing. No judge is present and the trustee does not have the authority to unilaterally dismiss your case without first filing a motion and noticing a hearing.
Where Do Orlando 341 Meetings Take Place?
Currently, most 341 meetings in the Middle District of Florida are conducted via Zoom.
Your attorney will give you exact instructions on how to login for the meeting. Generally, you will want to make sure you have downloaded the Zoom app (including any updates), and that you have a quiet room where you can attend the meeting in private.
How Long Does It Last?
Most meetings take 10 to 15 minutes once your case is called.
What Should You Bring?
Since the meeting is virtual, you will not need to bring anything with you. However, it may be useful to have a print out of your petition, schedules, and statements handy, in case the trustee directs you to a specific item in your filing paperwork when s/he is conducting your meeting. Prior to the meeting, your attorney will meet with you to prepare and should have already provided the following to the trustee prior to the meeting:
Photo ID (Some trustees also require a color photo of you holding up your ID)
Social Security card
Any documents the trustee specifically requested
Questions the Trustee Will Ask
Expect simple questions such as:
“Did you review your bankruptcy petition before signing it?”
“Is everything in your schedules true and correct?”
“Have you sold or transferred any property recently?”
“Do you expect any inheritance, lawsuit proceeds, or tax refunds?”
These questions verify the information you disclosed in your petition and schedules.
That’s it.
Do Creditors Attend?
Almost never. Although creditors receive notice of the meeting and are invited to attend, in the vast majority of personal Chapter 7 cases filed in Orlando, no creditors show up.
After the Meeting
Once the 341 meeting is complete, most individuals receive their discharge within 60–90 days.
